Complying with the Employment (Amendment) Act 2022 in the Year 2023

Recently, Minister of Human Resources, V. Sivakumar has confirmed that the Malaysia Employment (Amendment) Act 2022 will come into effect on the 1st of January 2023.  Thus, employers and HR managers need to take note of the amendments that will affect the company’s operation and workforce planning. In this article, we have summarized some of the amendments related to time and attendance and employee leave management.

Employee Working Hours

1.Flexible working arrangements

The amended Employment Act includes flexible working arrangements that allow the employee to apply to their employers for varying hours of work, days of work or places of work concerning their employment.

2.Change in the employee maximum working hours

Previously, employees in Malaysia had a maximum number of weekly working hours of 48 hours, however starting from 1st January 2023, the maximum working hours per week have been reduced to 45 hours. Employers should also be mindful that the other existing provisions of working hours under Section 60A (1) of the Employment Act (EA) 1955 remain.

Employee Working Scheduling

Description:

Employee shall not be required under his contract of service to work:

i) More than five consecutive hours without a period of leisure of no less than thirty minutes.

ii) More than eight hours in one day.

iii) [Section 59 (1)] Employees shall be allowed each week a rest day of one whole day.

Employee Leaves Entitlement 

1.Increased paid maternity leave

Paid maternity leave entitlement for working mothers who are recovering post-delivery has increased from 60 days to 98 days.

2.Introduction of paid paternity leave

The new amendment includes a provision for working fathers to 7 days of consecutive paid paternity leave under Subsection 60FA.

3.Separation of hospitalization leave from sick leave

Employees will be entitled to a hospitalization leave of 60 days per year and separated from the sick leave entitlement of 14, 18 or 22 days, depending on the employee’s total year of service.
