Appeals court dismisses Deepak's bid to restore suit against Najib, others

The Court of Appeal today dismissed an appeal by businessperson JR Deepak Jaikishan, his brother and their company to reinstate a lawsuit against Najib Abdul Razak, his wife Rosmah Mansor and three others over alleged claim of conspiracy that resulted in them to suffer losses.

Judge Azizah Nawawi, who delivered the unanimous decision of the Court of Appeal three-member panel, said it was a proper case to be struck out as the element of fraud, conspiracy, malfeasance and abuse of process, as claimed by the Deepak, J Rajesh and Radiant Splendor Sdn Bhd, had not been made out.
